TERMS AND CONDITIONS

This document describes the terms and conditions and the privacy policies applicable to the use of the services offered by FLOR AMAZONA within the site www.floramazona.com and other related domains. Any person who subscribes to www.floramazona.com or wishes to use the services offered, has full right to do so, but must comply with the Terms and Conditions and the Privacy policies pre-established in the document “Terms and Conditions”. These terms and conditions of sale will be governed in accordance with the laws applicable in the Republic of Colombia. Any dispute arising from this document will be submitted to the competent jurisdiction in accordance with Colombian law, and both FLOR AMAZONA and the client expressly waive any other jurisdiction that may correspond to them due to their present or future domicile.

It is necessary that the user READ, UNDERSTAND and ACCEPT all the conditions established in this document prior to registering as a user or to the acquisition of products or services through www.floramazona.com. By using this site, the user is fully accepting the conditions established in the Terms and Conditions and the Privacy Policies of FLOR AMAZONA and, therefore, the User is obliged to comply with all the pre-established conditions without being able to claim ignorance of such Terms and Conditions and Privacy Policies.

SECTION 1 – REGISTRATION AND USE OF THE SITE

To become an authorized user of www.floramazona.com, purchase products and access the promotions offered on the site, it is necessary to complete the registration form in all mandatory fields with valid data in an exact, accurate and true way. The user undertakes to update the personal data used at the time of completing the registration form when necessary. FLOR AMAZONA is not responsible for the certainty of the personal data provided by its users. Each user is responsible for the accuracy and veracity of the personal data entered into the system. Each natural and / or legal person can only hold an account at www.floramazona.com. If a person modifies or alters their personal data in any way possible to access more than one account and a fraudulent or malicious use is suspected or verified, www.floramazona.com has the final right to terminate the credits of this user, disable your accounts in the system and prosecute offenders legally.

FLOR AMAZONA has the right to request some extra data or proof to corroborate the personal data entered by users. You also have the right to temporarily or permanently suspend users whose data is not confirmed and refuses to provide proof or extra information requested. If a user is suspended, FLOR AMAZONA may retract a purchase made by the user without it being entitled to compensation.

When a new member registers, he will have his email address or user and a personal password that allows him a confidential and secure access to the page www.floramazona.com. The user assumes full responsibility for keeping his password confidential as this allows him to make purchases and obtain personal information. The delivery to third parties of the personal password of each user does not involve the responsibility of FLOR AMAZONA. The user is responsible for all operations made from his account and his password must be personal and exclusive. It is the user’s responsibility to notify FLOR AMAZONA immediately of any unauthorized use of their account or password. The sale, loan or transfer of password or account between users is totally prohibited.

FLOR AMAZONA reserves the right to refuse any registration request or to cancel a previously accepted registration at any time without being obliged to state the reasons for its decision and without generating any right to compensation.

SECTION 2 – AMENDMENTS TO THE AGREEMENT

FLOR AMAZONA may modify the Terms and Conditions at any time. The modified terms will become effective 10 days after their publication. Within the first 5 days after publishing the new modifications, the user must contact www.floramazona.com by email if they do not accept the new Terms and Conditions. In case you do not accept them, the user will be disabled as a member. If the 5-day period expires, the user will be deemed to accept the new Terms and Conditions and the contract between both parties will not be affected.

SECTION 3 – PAYMENT MEDIA

The products and services offered on www.floramazona.com can only be paid with the means indicated in each specific case. The use of a credit card is subject to what is established in these Terms and Conditions and to what is agreed in the respective cases of opening contracts and use regulations with its issuer. FLOR AMAZONA may determine purchase conditions according to the payment method chosen by the user. FLOR AMAZONA has the right to determine the maximum amount of credits that the user can use per purchase and the user will be notified prior to initiating the payment process. The credits that are used by the users will not be refunded in case of return of the products.

SECTION 4 – FORMATION OF CONSENT IN CONTRACTS CONCLUDED THROUGH THIS SITE

Through www.floramazona.com, offers of goods and services will be made that can be accepted using the mechanisms offered. All acceptance of an offer by a user is subject to suspensive condition until the transaction is validated. For any operation that is carried out on www.floramazona.com, the validation by the supplier is a requirement for the formation of consent. To validate each transaction, you must first verify that the payment method offered by the user is valid, the data registered by the client on the site match those provided when the offer was accepted and that the payment is credited by the user. To inform the user about the validation of the offer, a confirmation will be sent to the same email address that the user has registered when subscribing. The consent will be understood to be formed from the moment this written confirmation is sent to the user and in the place where it was issued.

The sale and dispatch of the products is conditional on their availability. If for any reason, a product is not available, and the customer was able to make a purchase of this product not available, the customer will be notified immediately and the total value of the price paid for the product will be remunerated.

SECTION 5 – OFFER VALIDITY AND PRICE DEADLINE

The offers on www.floramazona.com will be valid until the effective date indicated in the promotion or until the quantities of products available for said promotion are exhausted. When no validity date is indicated in a promotion, it will be understood that the offer will be existing until the corresponding inventories are exhausted. The prices of the products and services published on www.floramazona.com will only be valid for purchases made through this medium. They will not be valid for other sales channels. All prices are expressed by default in US dollars and will be converted to the currency of the user’s country of residence. The prices offered do not include transportation, handling, shipping and accessories that are not expressly described in the product descriptions.

It is possible that some products may have an incorrect price. If a typographical error is identified in any of the product prices, customers will be contacted before dispatching the products and notified of the error. Products will not ship until the correct price is canceled.

SECTION 6 – PROMOTIONS

The promotions offered on www.floramazona.com will not be valid on other sales channels. When promotions are made that consist of lowering the price or sending a product free of charge for the purchase of another, the two products must be delivered to the same site. Suppliers submit their promotions to the provisions of Law 1480 of 2011.

When discount coupons are offered, the value of the coupon, the minimum purchase amount to use the coupon and the dates on which it can be used will be clarified. Any natural person over 18 years old can use coupons. Coupons cannot be combined with other promotions and can only be used once per customer. The maximum purchase amount for the use of coupons is 10 million pesos.

SECTION 7 – DISPATCH OF PRODUCTS

Products purchased through our FLOR AMAZONA online store are subject to the shipping conditions chosen by the user and the delivery conditions available in our online store. The user will freely choose the address of the shipping location.

After the payment is approved and the order is dispatched, FLOR AMAZONA will notify the Customer by email of the date of delivery of his order.

In the event that no one receives the order at the shipping address, a second attempt will be made during the next three days. If after this attempt nobody receives the order, the user must contact us at the email contact@floramazona.com and the cost of the new shipment is borne by the customer. If the customer does not make a new shipment during the next 5 days after the second attempt, the product is declared in a state of abandonment and there will be no compensation. In this case, FLOR AMAZONA will not respond for products not received.

If the customer chooses the payment on delivery, and does not cancel the entire product and shipping pre-established in the order, it is understood that there is a breach of the contract and the customer must cancel the value corresponding to the return of the products.

It is understood that any person who is in the place indicated by the Client for the delivery of the products is authorized to receive the order, therefore, FLOR AMAZONA is exempt from any claim derived from the delivery made in the indicated place for the client.

SECTION 8 – GUARANTEE OF THE PRODUCTS OFFERED

The warranty for manufacturing defects is six (6) months. It does not cover the natural wear and tear of the product with the use, nor the damages caused by misuse of the same, such as:

  • Submerges
  • Resale chain or bracelet.
  • Rupture or loss of precious stones, or any stone set in the jewel.
    Damage caused by the jewel by contact with: sweat, chlorine, salt water, chemicals, cleaning products, makeup, hot water, perfumes, creams and lacquers.
  • Change in the natural state of the precious or semiprecious stone.
    The jewels require periodic maintenance (gold plating) to preserve the brightness and color.
  • The gold plating, with the use and contact with creams, perfumes and soaps tends to get lost, which is not a factory defect of the product and therefore the warranty does not cover it.
  • Enameled jewels are especially sensitive to shock and contact with chemicals. The warranty does not cover loss of enamelling by shocks, scratches or exposure to corrosive substances by the customer.
  • The jewels with stones suffer deterioration of the setting with normal use, when they are struck or rubbed, causing the stones to be released, which is not a defect of the product and is not covered by the warranty.
  • The fabric of some bracelets and chains over time is stretched, without this being a manufacturing defect.
    Warranty claim procedure

Bring or send the jewel to FLOR AMAZONA with the invoice. The product is sent to the company’s workshop where it will be reviewed by the respective technician giving response in five (5) business days. The indicated time does not include the time required for the arrangement of the product.

SECTION 9 – INTELLECTUAL AND INDUSTRIAL PROPERTY

Absolutely all the content available to the user at www.floramazona.com, including intellectual and industrial property, is the exclusive property of FLOR AMAZONA or of the companies providing the products. Users must refrain from reusing the content www.floramazona.com without the prior consent of FLOR AMAZONA.

SECTION 10 – INTELLECTUAL PROPERTY OF THIRD PARTIES

FLOR AMAZONA has tools to ensure that the products purchased using our services are original and have been legally entered into the country. If in any way you as a user suspect that any product published on www.floramazona.com infringes intellectual property or legal rights, we appreciate notifying you to contact@floramazona.com to submit it for review.

SECTION 11 – RESTRICTIONS

FLOR AMAZONA may temporarily restrict or suspend user accounts in order to perform maintenance or introduce improvements to the site.

SECTION 12 – NOTIFICATIONS

Any comments or concerns regarding the Terms and Conditions or the Privacy Policy must be expressly notified in writing to FLOR AMAZONA at the address contact@floramazona.com.
